1. Introduction
These Terms and Conditions ("Terms") govern the use of logistics services provided by MINT Logistics Private Limited ("MINT Logistics", "we", "us", or "our"), a company incorporated under the laws of India with CIN U74900MH2009PTC197891, having its registered office at 302 Creative Industrial Estate, NM Joshi Marg, Lower Parel East, Mumbai 400011, Maharashtra, India.
By using our website www.mintlogistics.co.in, mobile application app.mintlogistics.co.in, or engaging our logistics services, you ("Customer", "Consignor", "Consignee", "you", or "your") agree to be bound by these Terms and Conditions.
If you do not agree to these Terms, please do not use our services or platform.
2. Definitions
- "Consignment" means goods, cargo, or materials entrusted to MINT Logistics for transportation
- "Consignor" means the party shipping the goods
- "Consignee" means the party receiving the goods
- "POD" means Proof of Delivery
- "Consignment Note" means the document issued at the time of lifting the consignment, containing shipment details and terms
- "Services" means all logistics, transportation, and related services provided by MINT Logistics
- "Platform" means our website, mobile application, and any digital medium operated by MINT Logistics
- "Contract" means any written agreement between MINT Logistics and the Customer for provision of services
3. Service Scope
3.1 Services Provided
MINT Logistics provides multi-modal logistics services including but not limited to:
- Rail-Road integrated Carrier transportation
- Door-to-door delivery services
- Hub-and-spoke distribution operations
- Shipment tracking and management
- Cargo handling and loading services
3.2 Service Areas
Our services cover routes connecting Western India (Gujarat, Maharashtra) to Eastern India (West Bengal), Northeast India (all seven states), and Sikkim, as detailed on our website and service documentation.
3.3 Minimum Requirements
- Minimum Billing Weight: 100 kg per consignment
- Consignments weighing less than 100 kg will be billed at the 100 kg rate
4. Booking and Orders
4.1 Booking Process
- Customers may book services through our Platform, by phone, email, or through authorized agents
- All bookings are subject to availability and acceptance by MINT Logistics
- An indent (booking request) must be placed with accurate consignment details
4.2 Consignment Information
Customers must provide:
- Accurate description of goods
- Correct weight and dimensions
- Complete consignor and consignee details with addresses
- Proper shipping documentation as required by law
- Invoice and other necessary documents for cargo movement
4.3 Incorrect or Incomplete Information
- Customers are solely responsible for providing accurate shipping information
- Customers must correct any documentation errors immediately upon notification
- Any liability arising from incorrect information provided by the Customer, including issues during government agency inspections, rests entirely with the Consignor and Consignee
- MINT Logistics shall not be held liable for delays, penalties, or legal consequences resulting from incorrect or incomplete customer-provided information
4.4 Cancellation of Bookings
- Customers may cancel a booking if the indent has been placed but MINT Logistics has not yet dispatched personnel or vehicles for cargo lifting
- Once our personnel or truck has been dispatched for pickup, the booking cannot be cancelled without charges
- Cancellation charges, if applicable, will be communicated at the time of cancellation request
5. Prohibited and Restricted Items
5.1 Railway Red List Items
As the majority of our cargo moves through the Indian Railway network, we strictly prohibit transportation of items on the Railway Red List, including but not limited to:
- Hazardous materials and dangerous goods
- Flammable materials and explosives
- Tobacco and tobacco products
- Alcohol and alcoholic beverages
- Any items prohibited under Indian Railway regulations
- Any items requiring special permits that the Customer has not obtained
5.2 Right to Refuse
MINT Logistics reserves the right to refuse transportation of any consignment that:
- Contains prohibited items
- Is improperly packaged or documented
- Poses safety or legal risks
- Violates applicable laws and regulations
6. Liability and Insurance
6.1 Limited Liability
IMPORTANT: MINT Logistics' liability for loss or damage to any consignment is limited to a maximum of ₹100 (Rupees One Hundred Only) per consignment, as stated in the Consignment Note issued at the time of cargo lifting.
6.2 POD and Consignment Note
At the time of lifting the consignment, MINT Logistics will provide:
- Proof of Delivery (POD) copy
- Consignment Note copy clearly stating our liability limitation
These documents form an integral part of the service agreement.
6.3 Insurance Recommendation
- MINT Logistics does NOT provide insurance coverage for shipments
- We strongly recommend that Consignors and/or Consignees obtain comprehensive insurance coverage for their cargo
- Customers are advised to insure goods for their full value with a reputable insurance provider
- MINT Logistics shall not be liable for any losses beyond the ₹100 limit stated in Section 6.1, regardless of the actual value of the consignment
6.4 Force Majeure
MINT Logistics shall not be liable for any delay, loss, or damage arising from:
- Acts of God (floods, earthquakes, storms, natural disasters)
- War, terrorism, civil unrest, or strikes
- Government actions, restrictions, or regulations
- Railway delays, cancellations, or service disruptions
- Road blockages, accidents, or traffic restrictions
- Any other circumstances beyond our reasonable control
In such events, MINT Logistics will inform the Customer and deliver the consignment as soon as circumstances permit. Our liability remains limited as per Section 6.1.
7. Delivery Terms
7.1 Delivery Timeframes
- Delivery timeframes are lane-dependent and will be communicated at the time of booking
- Estimated delivery times are indicative and not guaranteed
- Actual delivery may vary based on operational conditions, route, mode of transport, and external factors
7.2 Delivery Delays
- In case of delays due to weather, strikes, accidents, or other unforeseen circumstances, MINT Logistics will inform the Customer promptly
- Delivery will be completed as soon as circumstances improve
- MINT Logistics has limited maneuverability during acts of God and shall not be held liable for delays caused by such events
7.3 Signature Requirement
- Delivery confirmation requires a signature from the Consignee on the Consignment Copy
- The signed Consignment Copy serves as proof that the material has been received by the Customer
- Without a signed POD, delivery shall not be considered complete
7.4 Failed Delivery
If delivery cannot be completed due to incorrect address, unavailability of Consignee, or refusal to accept, the consignment may be returned or stored at Customer's risk and expense. Storage charges and return freight shall be borne by the Customer.
8. Payment Terms
8.1 Payment Terms
- Payment terms are as per the written Contract between MINT Logistics and the Customer
- In the absence of a Contract, payment must be cleared upon delivery of the consignment
- All payments must be made in Indian Rupees (INR)
8.2 Payment Methods
We accept the following payment methods:
- RTGS (Real Time Gross Settlement)
- NEFT (National Electronic Funds Transfer)
- Online payment gateway (Paytm and other authorized partners)
- Other methods as mutually agreed in writing
8.3 Late Payment Charges
- If payment is not received within the agreed payment terms or within 30 days of delivery (whichever is applicable), a late payment fee of 18% per annum will be charged
- Late payment charges will be calculated from the date of invoice or 30 days from delivery date, whichever is earlier
- MINT Logistics reserves the right to suspend services to Customers with outstanding payments
8.4 Pricing
- Pricing is based on weight, volume, route, mode of transport, and service type
- Prices are subject to change without prior notice
- Applicable taxes (GST and other statutory levies) will be charged extra unless otherwise specified
9. User Accounts and Platform Usage
9.1 Account Registration
- To use certain features of our Platform, you may need to create a user account
- You must provide accurate and complete registration information
- You are responsible for maintaining the confidentiality of your login credentials
9.2 Account Security
- Users are solely responsible for keeping their login credentials (username and password) secure
- You must notify us immediately of any unauthorized use of your account
- MINT Logistics shall not be liable for any loss or damage arising from unauthorized access to your account due to your failure to keep credentials secure
9.3 Account Suspension or Termination
MINT Logistics reserves the right to suspend or terminate user accounts if:
- The account is being used in a manner detrimental to the company
- The account is being used in an abusive, fraudulent, or illegal manner
- There is a violation of these Terms and Conditions
- There are outstanding payment obligations
9.4 Acceptable Use
Users must not:
- Use the Platform for any unlawful purpose
- Attempt to gain unauthorized access to our systems
- Upload or transmit viruses, malware, or harmful code
- Interfere with the proper functioning of the Platform
- Misuse, copy, or redistribute our content without authorization
10. Intellectual Property Rights
10.1 Ownership
All content on our Platform, including but not limited to:
- Website design, layout, and graphics
- Mobile application interface and features
- MINT Logistics logo, trademarks, and brand names
- Text, images, videos, and other media
- Software, code, and databases
are the exclusive intellectual property of MINT Logistics Private Limited and are protected under Indian and international intellectual property laws.
10.2 Restrictions
You may not:
- Copy, reproduce, modify, or distribute our content without written permission
- Use our trademarks or branding without authorization
- Reverse engineer or decompile our software or applications
- Create derivative works based on our Platform
10.3 User Content
Any content you submit through our Platform (reviews, feedback, etc.) may be used by MINT Logistics for business purposes, and you grant us a non-exclusive license to use such content.
11. Data Protection and Privacy
Your use of our services is also governed by our Privacy Policy. By using our services, you consent to the collection and use of your information as described in the Privacy Policy.
12. Dispute Resolution
12.1 Arbitration
In the event of any dispute, controversy, or claim arising out of or relating to these Terms or our services:
- The parties shall first attempt to resolve the matter through good-faith negotiation
- If negotiation fails, the dispute shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996
- Arbitration shall be conducted in Mumbai, India
- The language of arbitration shall be English
- The decision of the arbitrator shall be final and binding on both parties
12.2 Jurisdiction
If arbitration fails or is not applicable:
- The courts of Mumbai, Maharashtra, India shall have exclusive jurisdiction
- These Terms shall be governed by the laws of India
- Any legal proceedings must be initiated in Mumbai courts only
12.3 Limitation Period
Any claims or disputes must be raised within 30 days of the event giving rise to the claim. Claims raised after this period may not be entertained.
13. Limitation of Liability
13.1 Maximum Liability
As stated in Section 6.1, MINT Logistics' maximum liability for any consignment is limited to ₹100 per consignment, regardless of the nature of the claim.
13.2 Indirect Damages
MINT Logistics shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, revenue, or business opportunities
- Loss of data or information
- Any damages exceeding the ₹100 limit per consignment
13.3 Service Availability
- MINT Logistics does not guarantee uninterrupted or error-free Platform services
- We reserve the right to modify, suspend, or discontinue any part of our services at any time
- We shall not be liable for any service interruptions or technical issues
14. Indemnification
You agree to indemnify and hold harmless MINT Logistics, its directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your violation of these Terms and Conditions
- Your violation of any applicable laws or regulations
- Inaccurate or fraudulent information provided by you
- Your negligence or willful misconduct
- Claims by third parties related to your consignment
15. Amendments and Modifications
15.1 Right to Modify
MINT Logistics reserves the right to modify, amend, or update these Terms and Conditions at any time without prior notice.
15.2 Notification
Changes will be effective immediately upon posting on our Platform. Continued use of our services after changes constitutes acceptance of the modified Terms.
15.3 Review Obligation
Customers are responsible for regularly reviewing these Terms to stay informed of any changes.
16. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
17. Waiver
Failure by MINT Logistics to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
18. Entire Agreement
These Terms and Conditions, together with our Privacy Policy and any written Contract, constitute the entire agreement between you and MINT Logistics regarding the use of our services.

20. Acknowledgment
By using MINT Logistics' services or Platform, you acknowledge that:
- You have read and understood these Terms and Conditions
- You agree to be bound by these Terms
- You accept our limited liability of ₹100 per consignment
- You understand the importance of obtaining insurance for your cargo
- You will comply with all applicable laws and regulations
